Warning under the Australian Consumer Law and Fair Trading Act 2012

If you sign this form, you will be agreeing that your rights to sue the supplier under the Australian Consumer Law and Fair Trading Act 2012 are excluded, restricted or modified in the way set out in this form, if you are killed or injured because the services provided were not in accordance with the statutory guarantees outlined below.

Under the Australian Consumer Law (Victoria), several statutory guarantees apply to the supply of certain goods and services. These guarantees mean that the supplier named on this form is required to ensure that the recreational services it supplies to you—

  • are rendered with due care and skill; and
  • are reasonably fit for any purpose which you, either expressly or by implication, make known to the supplier; and
  • might reasonably be expected to achieve any result you have made known to the supplier.

Under section 22 of the Australian Consumer Law and Fair Trading Act 2012, the exclusion of these statutory guarantees is brought to your attention by this form.

NOTE: The change to your rights, as set out in this form, does not apply if your death or injury is due to gross negligence on the supplier's part. Gross negligence, in relation to an act or omission, means doing the act or omitting to do an act with reckless disregard, with or without consciousness, for the consequences of the act or omission. See regulation 5 of the Australian Consumer Law and Fair Trading Regulations 2012 and section 22(3)(b) of the Australian Consumer Law and Fair Trading Act 2012.

The supplier named in this form is Scott McQueen, trading as Systema Melbourne. For the seminar on Saturday 7 November 2026, it also covers the guest instructor teaching that day, Cristian Isbasescu.

What you are taking part in

Systema is a contact martial art. Classes and seminars include striking, partner drills and work at varying intensity. There is a real risk of injury. Bruising and sprains are common. Joint injuries happen. Serious injury is rare but possible.

You set your own intensity and you can stop or step out at any time. Tell your partner and your instructor if something is too hard, too fast, or hurts.

What you are telling us

Your health

You confirm you have no medical condition, injury or physical limitation that makes contact martial arts training unsafe for you, or that you have told us about it below. If something changes, tell your instructor before the class it affects.

First aid

You agree that instructors or other participants may give you first aid if you are injured, and that we may call your emergency contact.

Your age

You confirm you are 18 or over. Classes and seminars are not open to under-18s, and this form does not cover anyone under 18.

Photographs

Tick if you are happy to appear in photographs or video from class on our website and social media. Leave it blank if you would rather not. Either is fine and it changes nothing else.

You sign this when you book. Pick what you are booking and the form appears.
